us, the better we can work for you.
All our design work is totally customized
-- never any generic templates, clipart
or software-generated graphics.
Processing
Your Order
When you complete the Web order form,
you will then proceed to our secure
e-commerce page. Here you may make payment
in real time by credit cardusing
PayPalor you may arrange to send
a check/money order to begin production
on your project. When we receive your
order and payment, we'll send you a
e-mail confirmation. If any information
is missing or we have questions, we'll
let you know at that time. Now, we begin
work on your web site.
Getting
Started
As the process is underway you will
be given a link to review the new site
(at anytime) as it evolves through the
conceptual stage until it's official
launch date. This insures that your
input is gathered and approved before
each stage of the development process.
We may ask for all your page copy/content,
any special graphics, logo or photos
deemed necessary.
1.
Discovery Stage
Before we start on developing a look
and feel we will need to understand
your project goals and requirements.
At this time we will have you complete
a basic form that will kick-off the
project and help answer these important
questions. From this information we
can then formulate a web strategy, understand
your target audiences and construct
proper architecture navigation for your
site.
2.
Creative Stage
Once we have an understanding of your
requirements (and have any necessary
graphic elements) we will begin on designing
several graphical layouts for you to
review. Your first drafts will often
arrive within 5-8 business days (depending
on the chosen package) following your
order. The drafts will be posted on
a Web server. Reviewing the first drafts
is an important step and your input
is highly welcomed and recommended.
3.
Production Stage
When a final graphical concept and
layout has been approved and signed-off
by the client, we will begin construction
and coding the HTML templates for your
site according to plan. Page copy and
keyword terms for optimizing your site
(for Search Engines) must be submitted
prior to this stage. There will be another
review and approval stage.
4.
Testing and Launch
As your project comes to completion
we will test your site thoroughly on
our project site for functionality,
loading time, browser compatibility
and be sure all links are in order.
Once approved we will officially launch
your site on the World Wide Web and
submit the URL to the top Search Engines
so you can be found by potential customers.
5.
Completion
After your project is completed, all
the rights to the final artwork and
pertaining electronic files will be
transferred to you by CD-ROM, FTP or
E-mail. Depending on the plan you select
you may be eligible for free Web update
(for a limited time) after your Web
site has been launched.
Revisions
Your satisfaction is our top priority.
Please feel comfortable asking for any
revisions since a new concepts triggers
new ideas. We're happy to revise the
look and feel the way you want and there
is no extra charge for up to 3 revisions
prior to Clients approval of the Creative
Stage.
Approval
Stages
Once drafts, templates or other stages
have been approved by client there will
be an additional charge for any modifications
after client sign-offs critical
stages. To save money, please be certain
before committing and approving stages.

Terms
& Conditions
1.
Assignment of web design project.
Maxam Design reserves the right to assign
subcontractors to this web design project
to insure that the terms of this agreement
are met as well as on-time completion.
2.
Copyright and Trademarks.
The client unconditionally guarantees
that any elements of text, graphics,
photos, designs, trademarks, or other
artwork furnished to Maxam Design for
inclusion in the web design project
are owned by the client, or that the
client has permission from the rightful
owner to use each of these elements,
and will hold harmless, protect and
defend Maxam Design and its subcontractors
from any claim or suit arising from
the use of such elements furnished by
the client.
3.
Payments
For projects estimated over $700
you
may pay for your project in full. As an
option, you may also choose to make two
partial payments outlined below:

1/2 at acceptance of proposal.
- 1/2
remaining balance to be paid upon delivery.
For
projects bid under $700:
Any
additional charges will be documented
and approve by Client prior to implementing.
Delinquent bills will be assessed a
$15 charge if payment is not received
within 10 days of the due date. If an
amount remains delinquent 30 days after
its due date, an additional 5% penalty
will be added for each month of delinquency.
Maxam Design reserves the right to remove
any web design project from viewing
on the Internet until final payment
is made. In case collection proves necessary,
the client agrees to pay all fees incurred
by that process. This becomes effective
when Client and provider acknowledge
this contact agreement. Regardless of
the place of signing of this agreement,
the client agrees that for purposes
of venue, this agreement was entered
into in Oceanside, California, US and
any dispute will be litigated or arbitrated
in Oceanside, California, US. Please
pay on time. The launch and transfer
of your web site, adding of Meta Tags
(Description and Keywords) and the submission
of the web design project to Web Search
engines and updating only occur after
the full final payment is made. All
payments will be made in US $ funds.
4.
Refunds
If Client is not satisfied with the
Web development process Client may ask
for a refund by completing our refund
form that will be supplied upon request.
To receive a full (100%) refund Client
must request the refund proir
to the Creative
Stage. If Client requests a refund
after the Creative
Stage and prior to the Production
Stage Maxam Design will refund half
(50%) of the total balance. Once Client
requests elecronic files or additional
revisions for any of the initial concepts,
Client shall forfeit the right to any
refund.
5.
Web Site Maintenance
If
the Basic+ or Pro+ plan are selected
this agreement includes minor web site
maintenance to pages for a 1-month period,
up to an average of one hour per regular
web site, including updating lines and
making minor changes to a sentence or
paragraph. It does not include updating
replacing nearly all the text from a
page with new text, major page reconstruction,
new pages, guest books, discussion webs,
navigation structure changes, attempted
updates by client repairs or web design
projects delivered to the client via
diskette. The period of 1 months begins
on the date the clients web design site
has been published to client's hosting
service or 30 days from the date this
agreement was signed, which ever comes
first. If the client's web design package
includes database access using Active
Server Pages (ASP), then very minor
page code changes will be accepted under
this maintenance plan, major page code
and/or database structural changes will
be charged at current hourly rates.
6.
Completion Date
Maxam Design and the client must
work together to complete the web design
project in a timely manner. Depending
on the size of the site, revisions and
unexpected delays, most sites may be
complete within 1-4 weeks. We agree
to work expeditiously to complete the
web design project no later than 45
days after the client has submitted
all necessary materials. This timeline
is based on Clients willingness to provide
necessary content and materials as well
as review and approval design stages
in a timely manner that keep the project
moving forward. If the client does not
supply Maxam Design with complete text
and graphic content for this web design
project within 30 days of the date this
agreement was signed, the entire amount
of the agreement becomes due and payable.
If the client still has not submitted
all the required contents within 45
days after signing this agreement, an
additional continuation fee of 15% of
the total agreement price will be assessed
for each month until the web design
project is published or the client cancels
the web design project in writing.
7.
Project Delivery
The web site design project may be published
to the client's hosting service upon
receipt of the second payment or delivered
via diskette upon receipt of full payment.
The client agrees to pay and select
a hosting service which allows Maxam
Design full access to the client's account
via FTP. The client will be solely responsible
for all hosting service charges. Publishing:
Maxam Design will use FTP to publish
to the site. Diskette: The client assumes
all responsibility for the use and functionality
of the web design project. If Client
prefers, Maxam Design can host Client
site for an additonal fee.
8.
Electronic Commerce Laws
The client agrees that the client is
solely responsible for complying with
such laws, taxes and tariffs, and will
hold harmless, protect, and defend Maxam
Design and its subcontractors from any
claim, suit, penalty, tax or tariff
arising from the client's exercise of
Internet electronic commerce.
9.
Web Design Project Copyright
Maxam Design owns copyright to the finished
web design site produced by Maxam Design.
The client will be assigned rights to
use the web design project as a web
site, once final payment under this
agreement and any additional charges
incurred have been paid. Rights to photos,
graphics, source code, work-up files
and computer programs are specifically
not transferred to the client, and remain
the property of their respective owners.
Maxam Design and its subcontractors
retain the right to display graphics
and other web design elements as examples
of their work in their respective portfolios.
All web design projects will contain
a copyright/legal page with a link to
Maxam Design web site.
